Scope
These Terms of Service govern use of mrblindbandit.net and related public website services operated by Kaeleb Savon Heck, professionally known as Mr. Blindbandit, in connection with Blindbandit Records. They cover the public website, account entry points, fan community, submission systems, browser utilities, Media Suite tools, and public-facing interactions. Separate signed agreements govern label, distribution, licensing, booking, employment, contractor, and other professional relationships when one exists.
Acceptance of these Terms
By accessing the website, creating an account, posting in the community, submitting music, using the Media Suite, joining a mailing list, or otherwise using an interactive feature, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the applicable interactive feature.
If you use the site on behalf of a company, band, label, organization, or other person, you represent that you have authority to bind that person for the activity you perform.
Incorporated policies
The Privacy Policy, Cookies and Storage Notice, Copyright Policy, Community Guidelines, Child Safety Policy, Advertising and Sponsorship Disclosure, Music Submission Terms, Media Suite Terms, and Accessibility Statement are incorporated into these Terms to the extent relevant to the feature being used. A separate label-portal notice and portal terms apply to invitation-only client functions.
If a signed agreement between Blindbandit Records and a client conflicts with these general website Terms about the subject specifically covered by the signed agreement, the signed agreement controls for that subject.
Eligibility, age, and legal capacity
The general public pages are intended for a general audience. Children under 13 must not create an account, post community content, subscribe to marketing, submit music, or knowingly provide personal information through interactive forms.
Users aged 13 through 17 may use ordinary public community features only where permitted by applicable law and with any required parent or guardian permission. A minor may not bind Blindbandit Records to a commercial agreement. Music or professional submissions by a minor may require parent or guardian authorization before negotiations, contracting, monetization, distribution, licensing, payment, or release services proceed.
Paid services, legally binding electronic signatures, and client agreements require the legal capacity to contract or participation by an authorized parent, guardian, or lawful representative.
Accounts and authentication
You must provide accurate information reasonably required for the account feature, protect credentials, use multi-factor authentication when available, and notify security@mrblindbandit.net if you believe an account is compromised.
You may not share invitation-only label access, bypass role restrictions, impersonate another person, automate unauthorized logins, harvest sessions, interfere with authentication, or attempt to obtain another person’s one-time codes or recovery credentials.
Community identity and label-portal identity may use related authentication technology but do not confer the same permissions. A community account never creates label-client status.
Community participation and user content
When you post a comment, community message, poll response, profile information, or other public contribution, you remain responsible for it. You grant the operator a worldwide, non-exclusive, royalty-free license to host, cache, reproduce, display, format, transmit, moderate, and make technical copies of that contribution solely as reasonably necessary to operate, secure, moderate, promote, archive, and provide the community feature. This license ends when the content is deleted from active service, except for reasonable backup, evidentiary, legal, and already-shared copies.
You represent that you have the rights necessary to post the content and that doing so does not violate another person’s copyright, trademark, privacy, publicity, confidentiality, contractual, or other rights.
Public posts may be copied, quoted, indexed, linked, or viewed outside the context in which they were posted. Do not place secrets, credentials, home addresses, financial data, government identifiers, intimate information, or private third-party information in public content.
Prohibited conduct
You may not use the service to harass, threaten, stalk, exploit, dox, defraud, impersonate, spam, distribute malware, defeat security controls, conduct credential attacks, organize unlawful transactions, facilitate sexual exploitation, publish non-consensual intimate material, promote terrorism, encourage imminent violence, or intentionally interfere with the service.
You may not use automated means to scrape private or access-controlled areas, overload the service, manipulate advertising impressions or clicks, manufacture fake engagement, bypass rate limits, defeat robot or security controls, or test security outside the scope of the published security reporting rules.
You may not upload or process files that you do not have the legal right to possess or use, nor use any tool to defeat DRM, access controls, paywalls, encryption, or technical restrictions.
Moderation, restriction, and appeals
The operator may remove, limit, label, demote, preserve, or restrict content or accounts when reasonably believed necessary to enforce these Terms, protect users, investigate abuse, comply with law, preserve evidence, address security risk, or protect the service. Moderation can be imperfect and is not a guarantee that every prohibited item will be detected immediately.
Where reasonably practicable, the affected user may receive a reason category and a route to appeal. Serious child-safety, credible threat, fraud, security, legal-preservation, or emergency matters may be restricted before notice. Abuse of the reporting or appeal process can itself be restricted.
Music submissions and professional inquiries
A submission is an invitation to review, not an offer or acceptance of a record deal, distribution agreement, license, booking, endorsement, employment relationship, fiduciary relationship, or confidential relationship.
Unless a separate confidentiality agreement was signed before submission, unsolicited material is not treated as confidential. Do not submit material that you are contractually prohibited from sharing. You retain ownership of your material, subject only to the limited technical permission necessary to receive, secure, transcode if necessary for review, play internally, evaluate, and respond to the submission.
Blindbandit Records does not promise that a submission will be reviewed within a particular time, accepted, released, distributed, monetized, or returned. Similar ideas, titles, styles, themes, or concepts may independently exist or be received from others.
Media Suite and browser utilities
The Media Suite may include an audio/video-to-audio converter, art-track generator, media or audio clipper, silence trimmer, audiogram generator, loudness normalizer, loudness and quality checker, metadata editor, waveform image generator, artwork resizer, lyric-video tool, thumbnail tools, and related utilities.
Unless the interface clearly states otherwise before processing begins, supported Media Suite tools are intended to process selected files locally in the visitor’s browser. The website does not acquire ownership of a user’s source file merely because the tool processes it.
You are responsible for keeping an original backup and confirming the output before deleting or replacing source material. Conversion, trimming, normalization, metadata editing, resizing, waveform generation, art-track rendering, or other processing can change technical properties, metadata, timing, loudness, quality, encoding, or compatibility. The tools do not guarantee acceptance by Apple Music, Spotify, YouTube, DistroKid, Symphonic, a broadcaster, a mastering standard, or any other third party.
An art-track or lyric-video output does not create distribution rights, Content ID rights, copyright ownership, publishing rights, synchronization rights, or permission to use underlying music, artwork, lyrics, fonts, trademarks, or footage. You must possess the rights needed for your intended output and distribution.
No circumvention or stream ripping
The Media Suite is a file-processing utility, not a system for downloading protected streams or defeating technological measures. Do not use it to circumvent DRM, extract protected platform streams, bypass subscriber controls, or copy material in violation of law or platform terms.
Output responsibility and technical limits
Browser performance, device memory, file size, codec support, WebAssembly capability, available storage, network delivery of software components, and third-party browser restrictions can affect whether processing succeeds. The operator may impose reasonable size, duration, format, queue, memory, or rate limits.
If a tool identifies loudness, clipping, sample rate, bitrate, metadata, dimensions, or another technical attribute, the result is informational and may not substitute for a professional quality-control process where a distributor, label, broadcaster, manufacturer, or contract requires one.
Third-party services, embeds, and links
The site may link to or embed services operated by Google, Spotify, Apple, YouTube, Clerk, PayPal, Wise, social networks, form providers, CDNs, or other companies. Their services are governed by their own terms and privacy practices. Availability, content, pricing, eligibility, and accessibility of third-party services can change without control by the operator.
A link, embed, or mention is not automatically an endorsement or warranty.
Advertising, affiliate links, and sponsorships
Public pages may display advertising. Sponsored content, free products, affiliate relationships, or other material connections will be disclosed where required and should be disclosed with the relevant endorsement or recommendation, not merely on a separate policy page.
You may not artificially click advertisements, instruct others to click ads as a form of support, use automated ad interaction, or otherwise manipulate ad delivery or measurement.
Support payments and tips
Off-site support links may allow voluntary payments through third-party payment services. Unless a page or separate agreement expressly states otherwise, support is voluntary, does not purchase equity, royalties, ownership, governance rights, a tax-deductible charitable donation, or a guaranteed product or service, and is subject to the payment provider’s rules.
Intellectual property belonging to the operator and others
The website design, original text, branding, logos, artwork, recordings, photographs, videos, code, and other materials may be protected by copyright, trademark, contract, or other rights. Rights remain with their respective owners. No license is granted except the limited right to access and use the website in accordance with these Terms.
You may share ordinary links to public pages. Commercial copying, republication, scraping, dataset creation, model training from access-controlled content, redistribution, or use of trademarks in a way that suggests sponsorship or affiliation requires permission unless applicable law independently permits it.
Copyright complaints
Copyright concerns should be sent to copyright@mrblindbandit.net with sufficient information to identify the work, locate the disputed material, contact the complaining party, and explain the basis for the request. The operator may request additional information, preserve relevant records, remove or restrict material, and notify the affected user.
Where a statutory notice-and-takedown system applies and the operator has completed the required service-provider formalities for that system, qualifying notices and counter-notices will be handled according to the applicable procedure.
Privacy and data protection
Personal information is handled according to the Privacy Policy and related notices. Do not use the community or Media Suite to collect, expose, or process another person’s personal information unlawfully. If a feature displays a consent or privacy choice, do not attempt to bypass or defeat that choice.
Accessibility
The operator intends the service to be usable by people with disabilities and targets WCAG 2.2 Level AA for website functionality under direct control. Accessibility feedback may be sent to accessibility@mrblindbandit.net. Third-party embeds and destinations can have their own accessibility limitations.
Security reporting
Good-faith reports of suspected vulnerabilities should be sent privately to security@mrblindbandit.net. Do not publicly disclose personal data, credentials, secret keys, or an unpatched vulnerability before the operator has a reasonable opportunity to investigate. The Security and Vulnerability Disclosure Policy defines authorized and prohibited testing.
Service changes and availability
The service may add, remove, suspend, repair, redesign, or discontinue features. Maintenance, third-party outages, browser changes, security events, legal requirements, resource limits, or abuse can affect availability. No uptime, preservation, delivery, review-time, or feature-continuity guarantee is made unless a separate signed service agreement says otherwise.
Suspension and termination
The operator may suspend or terminate access for material or repeated violations, security risk, fraud, unlawful activity, abuse of staff or users, nonpayment under a separate agreement, or legal requirements. Where reasonable and safe, the user may receive notice and a chance to appeal. Termination does not erase rights or obligations that by their nature survive, including intellectual-property rights, payment obligations, legal holds, security records, dispute provisions, and liability limitations.
Disclaimers
To the maximum extent permitted by applicable law, the public website and free utilities are provided on an “as is” and “as available” basis. The operator does not warrant uninterrupted operation, error-free conversion, preservation of metadata, commercial results, distribution acceptance, platform availability, or that every harmful user contribution will be detected.
Nothing in these Terms excludes warranties, guarantees, remedies, or consumer rights that applicable law does not permit to be excluded.
Limitation of liability
To the maximum extent permitted by law, the operator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from free public-site use, including lost profits, lost opportunity, lost data, reputational loss, or third-party service failure, where such exclusion is legally permitted.
For claims arising solely from free public-site or free Media Suite use, aggregate liability will not exceed the greater of the amount the claimant actually paid directly to the operator for the specific website service during the twelve months before the event or US$100, except where applicable law forbids that limitation. This limitation does not apply to liability that cannot lawfully be limited, including where a jurisdiction prohibits limitation for fraud, intentional misconduct, gross negligence, death or personal injury, or mandatory consumer remedies.
Indemnity
To the extent permitted by law, a user who uses the service commercially or submits content agrees to defend and indemnify the operator against third-party claims arising from that user’s unlawful content, infringement, fraud, deliberate security abuse, or material breach of these Terms. This does not require a consumer to surrender non-waivable rights or indemnify the operator for the operator’s own unlawful conduct.
Electronic communications and signatures
You consent to receive service-related notices electronically where legally permitted, including by email, account notice, or website posting. Marketing communications are governed separately and can be unsubscribed from.
Clicking “reviewed,” viewing a document, or acknowledging receipt does not by itself create an electronic signature unless the interface expressly identifies an action as a signature or acceptance of a specified agreement and captures the records necessary for that purpose.
Governing law and disputes
Unless a separate signed agreement says otherwise, these general website Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws principles, while preserving any mandatory consumer or data-protection rights that cannot lawfully be waived based on the user’s location.
To the extent a dispute may lawfully be required to proceed in a particular forum, the parties should first attempt good-faith informal resolution through legal@mrblindbandit.net. Nothing here prevents either party from seeking urgent relief where necessary to protect safety, security, intellectual property, or evidence.
No forced arbitration or class-waiver term in these general Terms
These general website Terms do not impose mandatory private arbitration or a class-action waiver. A separate negotiated commercial agreement may contain different dispute procedures if legally valid and expressly agreed.
Assignment, severability, waiver, and entire terms
You may not assign an account or a personal right under these Terms to evade restrictions without consent. The operator may assign website operations as part of a legitimate reorganization, transfer, or succession subject to applicable law and privacy obligations.
If a provision is unenforceable, it should be enforced to the maximum lawful extent and the remainder should continue. Failure to enforce a provision once is not a permanent waiver. These Terms and incorporated policies form the general agreement for public website use except where a separate signed agreement controls.
Changes to these Terms
The effective date identifies the current version. Material changes may receive additional notice where appropriate. Changes do not retroactively rewrite a separate signed agreement unless that agreement lawfully permits the change. Continued use can evidence acceptance only where applicable law allows that method; consent will still be requested where the law requires affirmative consent.
